Cheating on WhatsApp: phone lying screen down on a bedside table

WhatsApp is now the starting point for most of the suspicions that reach us. It is where conversations happen, which is why so many people ask how to find out about cheating on WhatsApp. The honest answer has two parts: there are signs you can observe without touching anyone's phone, and there is a line you should not cross — because spying on your partner's phone may be a crime in Portugal. In this guide we explain the signs, the most common legal mistakes and the safe alternative: a professional infidelity investigation.

Quick answer: how do you find out about cheating on WhatsApp?

It is not legally possible to read another person's WhatsApp conversations without their consent. What you can do is observe changes in behaviour around the phone: screen face down, notifications without previews, a changed passcode, archived or deleted chats and use at unusual hours. These signs do not prove cheating. If the doubt persists, the legal way to settle it is a professional investigation, which documents meetings and behaviour in public places, not messages.

The signs of cheating on WhatsApp you can observe without touching the phone

1. The screen is now always face down

On the table, on the sofa, on the bedside table: the phone is systematically left screen down, or the body turns to hide it when a message arrives. On its own it is a common habit; it becomes a sign when it is new.

2. Hidden or silenced notifications

Message previews disappear and you now see only «1 new message». Sound and vibration are switched off, or one specific chat is muted. Someone with nothing to hide rarely changes these settings overnight.

3. A changed passcode, PIN or biometrics

The passcode you knew no longer works, your fingerprint has been removed or WhatsApp now asks for its own lock. The change is usually explained by «security» or an update.

4. Archived, deleted or disappearing chats

A chat list that is too tidy, disappearing messages switched on with only one contact, or a recent habit of deleting conversations. It is one of the signs most often mentioned by people who come to us — and one of the hardest to interpret without context.

On where the line is on Instagram and Facebook, read our guide to micro-cheating on social media.

5. The phone goes everywhere

To the bathroom, into the shower, out to the bins. It is no longer left charging in the living room and is never lent, not even for a photo.

6. «Online» at odd hours

In the early hours, first thing on waking, during supposed meetings. The status visible to any contact may show a pattern, but it does not say who they are talking to or about what. Obsessively watching this status feeds anxiety and settles nothing.

7. A contact with a strange name or no photo

Generic names like «Plumber» or «Work 2», initials, or a contact with no photo who often appears in the call log. It is a classic clue — but you only see it by chance, not by looking for it.

8. A disproportionate reaction when you go near the phone

Picking up the phone to check the time now causes tension, a dash to get it back or an argument. Defensiveness is one of the most recurring behaviours, and we describe it in detail in our article on the 10 silent signs of cheating.

Why these signs are not enough as proof

All of them have innocent explanations: work groups, a surprise being planned, a problem the person doesn't want to share yet, or simply the right to privacy, which exists inside a relationship too. What should carry weight is the change, how long it lasts and the sum of several signs — on and off the phone. That is why the next step should never be to go and read the messages.

The legal mistakes to avoid: what may be a crime in Portugal

Being married or living together does not give you a right of access to the other person's communications. When suspicion tightens its grip, these are the most common mistakes:

  • Reading the conversations in secret. Accessing another person's phone or account without permission may amount to the offences of unlawful access (Cybercrime Law) and breach of correspondence or telecommunications (Criminal Code).

  • Linking WhatsApp Web or another device to his or her account. It is unauthorised access like any other, and it is recorded under linked devices.

  • Installing spy apps. The websites that sell them say they are legal; installing them on another adult's phone without consent may be a crime.

  • Taking screenshots and sharing them. Disclosing private conversations to family, friends or on social media may amount to invasion of privacy.

  • Recording calls or conversations you are not part of. Recordings made without consent may be unlawful.

These offences may be punished with imprisonment or a fine. In practice, the person who spied can go from being the one deceived to being a defendant. This article is for information and is no substitute for a lawyer's advice.

«I only wanted to know the truth»: what happens to illegally obtained evidence

Beyond the criminal risk, there is a practical problem: evidence obtained through unauthorised access may have no value at all in divorce or parental responsibility proceedings, and may harm the position of the person presenting it. If marriage, children or assets are at stake, speak to a lawyer first. We have put together a list of the best family law attorneys in Portugal.

If you are already thinking about divorce, see which proof of infidelity has legal value in Portugal.

What if you are the one being spied on?

Suspicion works both ways. In WhatsApp, open Settings, Linked devices, and log out of any session you don't recognise. A battery that drains quickly, a phone that is warm when idle or apps you didn't install deserve attention. If the suspicion is serious, an electronic sweep to detect listening devices and trackers can confirm whether surveillance software or equipment is present.

The safe and legal alternative: a professional investigation

What a private detective does not do

A detective does not access anyone's WhatsApp, recover third parties' messages, install apps or intercept communications. Anyone who promises you that is proposing a crime — and, often, a scam. We explain the limits in our article on social media and WhatsApp evidence.

What a private detective does

A detective documents what happens off screen: who the person meets, where and when. The work begins with a free and confidential initial assessment, followed by a plan focused on the most likely days and times and a fixed quote with no hidden costs — learn more about how much a private investigator costs in Portugal. Surveillance is carried out in public places, discreetly and within the law, and ends with a written report with photographs and video. To organise the fieldwork we normally need 24 hours' notice.

A WhatsApp conversation can be ambiguous; a documented meeting is not. And there are cases where the investigation shows there is nobody else. All investigations are coordinated by detective Alexandre Ribeiro, a member of WAD (no. 1687), APDPE (no. 1326), LIDEPPE (member no. 33) and IKD.

What to do now: 4 steps

1. Stop before touching the phone

It is the hardest step and the one that protects you most. Anything you do from that point on can be used against you.

If you have already found something, read the 3 essential steps before you confront.

2. Record what you observe

Dates, times and specific behaviours, on and off the phone. A simple record helps you see whether there is a pattern.

To organise what you have observed, take the 7-question infidelity test.

3. Talk at a calm moment

Talk about what you have observed and how you feel, without accusing. Many doubts are resolved here.

4. Ask for professional confirmation

If the doubt persists, an infidelity investigation lets you confirm or rule out the suspicion with facts, legally and discreetly.

Frequently asked questions about cheating on WhatsApp

Is it possible to find out about cheating on WhatsApp without accessing the phone?

You can observe behavioural signs, such as the screen face down, hidden notifications or a new passcode, but you cannot read the conversations. To confirm the suspicion legally, the route is a professional investigation, which documents meetings and behaviour in public places.

Is it a crime to look at my husband's or wife's WhatsApp in Portugal?

It can be. Accessing another person's phone or account without permission may amount to the offences of unlawful access and breach of correspondence or telecommunications, even between spouses.

Can I use WhatsApp screenshots in court?

It depends on how they were obtained. Evidence obtained through unauthorised access may have no value and may expose the person who obtained it to criminal liability. The decision always rests with the court; speak to a lawyer before using it.

Are WhatsApp spy apps legal?

Installing a spy app on another adult's phone without their consent may be a criminal offence in Portugal, whatever the websites selling them claim.

Can a private detective access someone else's WhatsApp?

No. A private detective cannot access third parties' phones, accounts or communications. The legal work consists of observing and documenting behaviour in public places.

How do I know if my WhatsApp is being spied on?

Check Settings, Linked devices, for any session you don't recognise and log it out. If you suspect spy apps or trackers, a professional electronic sweep can confirm it.
