Phone tapped: smartphone with an active call lying on a desk at night

Quick answer

A legal phone tap in Portugal can only be ordered by an investigating judge, is carried out through the carrier and leaves no trace on your phone: no noises, no echoes and no battery drain caused by it. What can be detected is something else: spyware installed on the device, call forwarding or shared accounts (iCloud, Google, WhatsApp Web). If you suspect someone is listening to your calls or reading your messages, the right approach is to check these three points and, if necessary, request a technical sweep of your phone.

What a phone tap really is

When people talk about a "tapped phone", they are usually mixing up two very different realities.

The legal wiretap (judicial interception)

In Portugal, the interception of communications is governed by the Code of Criminal Procedure (articles 187 to 190). It is only possible within a criminal case, for offences of a certain seriousness, by order of an investigating judge, at the request of the Public Prosecutor's Office. It is carried out by the criminal police bodies with the cooperation of the telecoms operator, on the network, not on your phone.

That is why a legal wiretap:

  • installs nothing on your device;

  • causes no noises, clicks, echoes or dropped calls;

  • uses no extra battery or data;

  • cannot be detected by you, by any detective or by any app.

If your concern is an official criminal investigation, the honest answer is this: there is no technical way to confirm it, and the conversation to have is with a lawyer.

The illegal "tap" (spying by private individuals)

In the overwhelming majority of cases that reach us, the one "listening" is not the police. It is someone close: an ex-partner, a spouse, a business partner, a colleague or a competitor. And that person has no access to the carrier's network. To spy, they need to get into your phone or your accounts. That is precisely what leaves a trail, and it is what can be detected.

The myths that waste your time

Some signs circulate online as "proof" of a tap and, in practice, almost never mean anything:

  • Noises, clicks or echo on calls: almost always network, VoLTE/VoWiFi or device problems. Modern taps are digital and silent.

  • Dropped calls: weak coverage, switching between cell towers or carrier faults.

  • The phone gets warm: this happens with games, GPS, the camera, fast charging or hot weather.

  • Hearing your own voice: acoustic echo, usually from the earpiece or the other person's phone.

On their own, these symptoms are no cause for alarm. What matters are the concrete signs we describe next.

Real signs that someone may have access to your phone

1. Someone knows what they shouldn't

This is the most important and the most common sign. The other person knows about private conversations, places you have been, or photos and messages you never shared. When this keeps happening, it is rarely a coincidence.

2. Call forwarding switched on without your knowledge

Forwarding set up without your knowledge can divert calls or voicemail to another number. You can check this in seconds with codes such as *#21#. It shows only whether calls are being forwarded; it does not detect spyware or legal wiretaps.

3. Sessions and devices you don't recognise

Often nothing needs to be installed on the phone at all: access to your account is enough.

  • WhatsApp: Settings › Linked devices. A WhatsApp Web session you didn't open lets someone read all your chats in real time. See our guide WhatsApp spied on: how to tell and how to protect your account.

  • iPhone: Settings › [your name] › the list of devices signed in with the same Apple ID.

  • Android: Google Account › Security › Your devices.

A shared iCloud or Google account gives access to photos, location, contacts and backups without ever touching the device.

4. Strange apps, profiles or permissions

  • Apps you didn't install, especially with generic names ("System Service", "Sync", "Update").

  • On Android, apps with accessibility, device administrator or notification access for no apparent reason.

  • On iPhone, configuration or management profiles (MDM) under Settings › General › VPN & Device Management, on a personal phone.

5. Abnormal data and battery use

On its own it proves nothing, but together with the signs above, a persistent rise in background mobile data or an unknown app at the top of battery usage deserves attention.

The complete step-by-step guide to all the signs is in How to Tell If Your Phone Is Being Spied On.

What to do if you suspect your phone is tapped

  1. Don't confront the person you suspect. If there is spyware, the warning gives them time to delete it and destroy the evidence.

  2. Don't factory-reset the phone right away. It solves the problem but erases the evidence that it ever existed.

  3. Talk about it on another device. Use a trusted phone or computer to ask for help.

  4. Check call forwarding and open sessions (WhatsApp, Apple ID, Google).

  5. Change your passwords from a secure device and turn on two-step verification.

  6. Request a technical sweep if the signs persist or if you need a report for a lawyer.

How a phone sweep works

A sweep is a technical analysis of the device and its linked accounts to detect spy software, management profiles, abusive permissions, forwarding and remote access. In our case:

  • the phone stays with us for about 12 hours;

  • it is analysed with forensic tools, without altering your data;

  • at the end, we deliver a written report with what was found and our security recommendations;

  • if spy software is found, the evidence is preserved so that you can decide the next steps with your lawyer.

Appointments are scheduled with 24 hours' notice. When the concern goes beyond the phone (home, car or office), we also carry out electronic sweeps of premises and vehicles and, if needed, digital forensic analysis.

Listening to someone without authorisation is a crime

Installing a spy app on someone else's phone, reading their messages without consent or recording their conversations may constitute a crime in Portugal, even between spouses or partners. If the surveillance is part of a pattern of control or stalking, the person affected should seek legal advice and keep all evidence. We explain the law in Wiretaps, recordings and trackers: what is a crime in Portugal. If the surveillance is part of a pattern of control or stalking, also read Stalking and technological control: trackers, cameras and spyware.

Who carries out this analysis

Sweeps and technical examinations are coordinated by Alexandre Ribeiro, a private detective with experience since 2001, member of the WAD (World Association of Detectives, no. 1687), APDPE (no. 1326), LIDEPPE (no. 33) and IKD. Detetives Privados Portugal operates nationwide, with teams in Porto, Lisbon and the rest of the country.

Frequently asked questions

How can I tell if my phone is being tapped by the police?

You can't. A judicial wiretap is ordered by an investigating judge and carried out on the carrier's network, with no change to your phone. No app or code detects it. If you fear you are under investigation, speak to a lawyer.

Do noises and echoes on calls mean I'm being tapped?

Almost never. Today's taps are digital and make no noise. Echoes, clicks and dropped calls usually come from network problems or the device itself.

Can an antivirus app detect that my phone is tapped?

It may detect some known spy apps on Android, but it often fails, especially with well-configured commercial spyware and with account-based access (iCloud, Google, WhatsApp Web). It is no substitute for a technical analysis.

Does the *#21# code show whether my phone is tapped?

No. *#21# only shows whether calls are being forwarded to another number. It is useful, but it does not detect spyware or legal wiretaps.

How long does a phone sweep take?

The phone stays with us for about 12 hours and we deliver a written report with the findings. Appointments are booked with 24 hours' notice.

Can I use the sweep report in legal proceedings?

The report describes technically what was found and preserves the evidence. How it can be used, and the weight it is given in proceedings, depend on the case and should be assessed with your lawyer.
